These Terms of Service (“Terms”) govern your use of abusayedtuhin.com (the “site”) and any SEO consulting services I provide. By using the site or engaging my services, you agree to these Terms. If you don’t agree, please don’t use the site or my services.
1. About This Site and Services
abusayedtuhin.com is operated by Abusayed Tuhin, an independent SEO consultant based in Mirpur, Dhaka, Bangladesh. I provide SEO consulting services including local SEO, e-commerce SEO, technical SEO, semantic SEO, GEO, AEO, audits, and related services. Some engagements may be delivered through my agency, Nexa Orbit, where applicable.
2. Use of the Site
You may use this site for personal and lawful business purposes. You may not:
- Use the site in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to the site, server, or related systems
- Use automated tools to scrape, harvest, or extract content
- Reproduce, duplicate, or republish my content without permission (see Section 5 — Intellectual Property)
- Use the site to send unsolicited marketing communications
- Interfere with or disrupt site functionality
3. Consulting Services — Engagement Terms
When you engage me for SEO consulting, the following terms apply unless overridden by a specific signed contract:
Scope of work: Defined in a written proposal or statement of work agreed before engagement begins. I deliver only what’s specified — additional work requires a separate agreement.
Deliverables: As specified in the proposal. Standard deliverables include audit reports, strategy documents, monthly reports, and direct consultation hours.
Timelines: SEO is a long-term discipline. I do not guarantee specific rankings, traffic volumes, or revenue outcomes. Realistic timelines are typically 3–4 months for early movement, 6–9 months for meaningful results, and 9–12 months for competitive markets.
Client responsibilities: You’re responsible for providing timely access to required tools (Google Search Console, Google Analytics, hosting, CMS), responding to questions within reasonable timeframes, and implementing recommendations or approving implementation by my team.
4. Payment Terms
Currencies accepted: BDT (for Bangladeshi clients) and USD (for international clients).
Payment methods: bKash, Nagad, Rocket, bank transfer, Wise, Payoneer, and other methods agreed in advance.
Invoicing: Retainers are invoiced monthly in advance. Project-based work is invoiced according to the agreed payment schedule.
Late payments: Invoices unpaid for more than 14 days may result in pause of services. Invoices unpaid for more than 30 days may result in termination of engagement.
Refunds: Onboarding fees and discovery audits are non-refundable once delivered. Monthly retainers are non-refundable for the current month but can be cancelled with 30 days’ notice. Project-based work refund terms are specified per project.
5. Intellectual Property
My content: All content on abusayedtuhin.com — including blog posts, case studies, service descriptions, images, code, and proprietary frameworks — is owned by me and protected by copyright and other intellectual property laws.
Your content: Content you provide to me (your website access, analytics, brand materials, business information) remains your property. I receive a limited license to use it solely for delivering services.
Deliverables: Strategy documents, audits, and reports created specifically for you become your property upon full payment. Underlying methodologies, frameworks, and proprietary processes remain mine.
Citations and case studies: I may reference your engagement as a case study (with verifiable metrics only) on my site or marketing materials, anonymizing identifying details if you request confidentiality.
6. Confidentiality
I maintain strict confidentiality about:
- Your business strategy, financials, and proprietary information
- Access credentials you share with me
- Internal communications and documents
- Specific client lists, contracts, and engagement details
If you require a separate Non-Disclosure Agreement, I’m happy to sign one before engagement.
7. No Guarantee of Results
SEO is influenced by many factors I don’t control, including:
- Google algorithm updates
- Competitor activity
- Your existing site authority and history
- The quality of implementation by your team
- Market conditions
I cannot and do not guarantee specific ranking positions, traffic volumes, conversion rates, or revenue outcomes. Anyone who guarantees these outcomes is misleading you. What I do commit to: ethical methodology, transparent reporting, and measurable improvement in the metrics that matter for your business.
8. Limitation of Liability
To the maximum extent permitted by law, my total liability for any claim arising out of or related to the site or services is limited to the fees you’ve paid me in the 3 months preceding the claim.
I’m not liable for:
- Indirect, incidental, special, or consequential damages
- Lost profits, lost revenue, or lost business opportunities
- Damage caused by your implementation of recommendations (where you handle implementation)
- Third-party platform changes (Google updates, hosting outages, etc.)
This section doesn’t limit liability where prohibited by applicable law (e.g., for gross negligence or fraud).
9. Termination
Either party can terminate an engagement with 30 days’ written notice. Outstanding invoices remain payable. I’ll deliver work-in-progress materials and provide reasonable handover support.
I reserve the right to terminate immediately if:
- Payment is more than 60 days overdue
- You request unethical SEO practices (PBNs, paid links, content scraping, etc.)
- You become abusive or harassing in communications
- Continuing the engagement would create legal or reputational risk
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of Bangladesh. Disputes will first be addressed through good-faith negotiation. If unresolved within 30 days, disputes will be settled through arbitration in Dhaka, Bangladesh, in accordance with the Arbitration Act, 2001.
For international clients, this clause is subject to mandatory consumer protection laws of your country of residence where they apply.
11. Changes to These Terms
I may update these Terms occasionally. The “Last Updated” date at the top reflects when changes were made. Material changes affecting active engagements will be communicated via email with at least 30 days’ notice. Continued use of the site or services after changes means you accept the updated Terms.
